eLive Auction General Terms and Conditions

Our below eLive Auctions General Terms and Conditions apply to all legal transactions between Hess-Divo AG (auctioneer) and the customer in the course of participation in the eLive Auction. All sales will be effected by payment in Swiss Francs with the addition of a buyer's premium of 15% on the hammer price. An additional Swiss sales tax of 8% is due on the hammer price and on the buyer's premium for silver and bronze coins, and for medals and banknotes, if they are delivered in Switzerland. Gold coins are generally tax-free in Switzerland. All fees and taxes due abroad are the buyer's responsibility. Payment in Swiss Francs (CHF) is due immediately after the lot is sold. Default interest of 1% per month on the purchase price will be charged for delayed payments. Full title to the goods is only transferred to the buyer upon complete payment. The buyer is personally liable for his own purchase; he can not claim to act on behalf of a third person. In case of a misunderstanding during the auction it will be the municipal representative's decision whether the lot will be put up again. The fall of the hammer commits the buyer to the acceptance of the lot. The descriptions and the states of preservation are given in good faith. The authenticity of the pieces is guaranteed. No complaints or returns can be accepted for multiple-lots. Justified complaints must be made within eight days of receipt of the merchandise. Shipment of the purchased lots will be effected at the expense and risk of the buyer upon receipt of full payment. The bidder accepts the conditions of sale set out above by the submission of bids, either verbal or written. Written bids will be carefully executed by Hess-Divo AG free of charge. Written bids below the estimated prices will not be accepted. In all other respects which are not governed by the present conditions of sale by auction, the provisions of the Ordinance issued by the Supreme Court of the Canton of Zurich on 19 December 1979, regarding the procedure of voluntary public sales by auction, shall be applicable. The only legally valid and binding text of the conditions of sale by auction is the German version. Exclusive jurisdiction for any legal proceedings shall be Z├╝rich 1.

For technical reasons, the estimations and hammer prices will be in euros. However our invoices will be issued in Swiss Francs (CHF).

Bid Increments

The minimum bid increments for the bidding procedure are:

When several identical bids are received, the bid received first is the winning bid.

Cost of Shipping

Upon acceptance of the winning bid and issuance of an invoice, payment is to be made to one of our below bank accounts within 14 days. We assume a majority of the costs involved in carefully packing and reliably dispatching the merchandise. We charge you for shipping costs according to the following schedule: Shipping within Switzerland: 15 CHF per parcel. Shipping outside Switzerland: 25 CHF per parcel. Some aditionnal handling fees might be charged in case of heavy or bulky items.
